4.1 The Company issues the following membership card categories:
- Honorary Members;
- Complimentary Members;
- Individual Members;
- Corporate Members;
- Floating Members;
- Short-term Members;
- Long-term Members;
- Junior Members;
- Other Cards issued by Company from time to time.
Information about categories of Membership Cards (duration, transference, fees…) is stated specifically in Appendix 1, attached with the Charters and Regulations
4.2 The Company has the sole right without question or recourse to issue new and/or amends, supplement various membership card categories, depending on the actual operation of the Club at each development period of the Company. The criteria and conditions for each membership card category are defined by the Company.
4.3 Member’s guest must be accompanied by the member at all times and obey the Club’s Charter and Regulations.
4.4 Joining Fee and Related Conditions are mentioned in the detailed Regulations on joining the Club, which is amended, supplemented and changed by the Company from time to time.
4.5 Annual Dues are explained in more detail in the “Table of Annual Dues” and in the “Regulation of Annual Dues”, which are issued and modified by the Company from time to time without prior notice, in which:
4.5.1. Annual dues of Individual, Corporate membership cards and Floating membership cards are collected yearly.
4.5.2. Annual dues for Complimentary and Honorary membership cards are collected yearly, or a standard playing fee is charged for each time the member plays, depending on the decision of the Company.
4.6 Duration of Membership are as follows:
4.6.1 Long-term Individual membership, Corporate membership and Floating membership will be terminated the right to use the membership card on the date displayed on the card.
4.6.2 Short-term Individual membership has duration depending on the value of membership card and the date displayed on the card.
4.6.3 Honorary membership and Elite & Prestige membership have duration according to the Company’s decision from time to time.
4.6.4 The membership card can be extended according to the Company’s Regulations.
5.1 First Application of Membership Card
5.1.1. Application and approval 01 (one) person/organization to becoming Membership must followed the Club/Company’s Regulations and approved by Company Leaders.
5.1.2. The applicant must attend an interview with the Manager and to ensure they understand all the club policies and rules and regulations. Applicant will acknowledge with a signature and be obligated to follow the club policies, rules and regulations at all times.
5.2. Re-application of Membership Card
5.2.1. In case the Membership Card is lost, stolen or damaged, Member has to inform to Company/Manager to regain the Membership Card.
5.2.2. Members have duty to pay for the Re-application fee according to Company’s Regulations at all times.
6.1 Member’s Privileges
6.1.1. The right to use the golf course, clubhouse and other facilities of the Club in accordance with the Regulations.
6.1.2 Discounts as offered and published from time to time and at the sole discretion of the Manager at the driving range, Pro-Shop, as well as other available services (if any).
6.1.3 The right to invite guests to the golf course in accordance with the Regulations (with the exception of Prestige Membership and Junior Membership).
6.1.4 The right subject to type and terms to transfer their membership card to another individual or corporation after paying the transfer fee and other related fees in full, as regulated by the Company at that time.
6.1.5 Priority tee time reservations according the Regulations of the Club.
6.1.6 Reciprocal playing privileges at other properties of BRG Golf in accordance to the policies issued by BRG Golf from time to time
6.1.7 The right to request an official handicap card provided and recorded by the Club.
6.1.8 The right to offer comments and suggestions to the Manager.
6.2 Member’s Obligations
6.2.1. To present the membership card bearing the member’s image when entering the Club and using the Club’s facilities;
6.2.2 To pay annual dues and related fees (if any) in full and in a timely manner according to the Company’s regulations;
6.2.3 To learn, update, respect and implement the Club’s rules, regulations policies.
6.2.4 Whenever possible to participate actively in club activities, strengthen and expand exchanges, cooperation and culture.
6.2.5 To accompany their guests at all times in the Club, remind guests of the Club’s Regulations and take full responsibility for all actions and behavior of their guests.
6.2.6 To pay penalty fees for violating this Charter, the Club’s regulations under the provisions of the Company at the time of violation, and pay compensation for damages for any Member or Member guest’s violation (if any) to people and/or property within the Club
6.2.7 In case Junior Members cause any damage, their legal guardians will be responsible and have to pay compensation for damages for Junior Member’s violation to people and/or property within the Club.
6.2.8 To maintain proper etiquette and sportsmanship within the spirit of the game.
6.2.9 Statement or action that affects the Golf Course, Company Leaders and other Member in both reputation and image are not allowed.
6.2.10 To abide all Golf Course’s instruction and request in handling issues that has not been stated in the regulations from time to time.
6.2.11 To abide other right and obligations according to Company’s Regulations from time to time.
7.1 Membership may be suspended or terminated by the Company immediately and without notice or recourse if the member commits any of the following actions:
7.1.1 Violates the Charter or Regulations of the Club issued by the company from time to time
7.1.2 Damages or reduces the value of any of the Club’s property or facilities without providing compensation as required by the Company;
7.1.3 Causes disruptions, disputes or fights with others in the Club;
7.1.4 Does not respect or execute his/her membership obligations;
7.1.5 Does not pay annual dues mentioned in Article 6.2 on time;
7.1.6 Any other action that the Company Leader deems a harmful effect to other Members/course.
7.2 Termination of Membership
The Company reserves the right to terminate membership in the followings cases:
7.2.1. Violate 02 (two) regulations in section 7.1 or violate 01 (one) regulation in section 7.1 twice or more.
7.2.2. Delaying fees payment mentioned in section 6.2 more than 30 (thirty) days since the due date.
Membership is ended from the moment Company releases Termination of Membership. In this case, Member will not be refunded any paid fee and still have to pay fees or debts (if any).
7.3 In addition of section 7.1, Company has the right to terminate membership as situations below:
7.3.1. The membership is transferred;
7.3.2 An Individual member’s death or loss of civil capacity but membership rights are not inherited according to provision 10 of the charter;
7.3.3 Dissolution, bankruptcy or the cessation of operations of a Corporate member;
7.3.4 Expiration of a membership card;
7.3.5 Dissolution of the Club ;
7.3.6 Other cases defined by the Company from time to time.
7.4 The Company Leader considers the suggestions of the manager before issuing a decision to suspend or terminate any membership. However, in all cases, the Company Leader’s decision is the full and final decision and will be followed accordingly.
8.1 Depend on category of Membership cards, Membership may be transferred to another individual or corporation. Conditions to transfer of Membership: (i) the Transferor has fully completed all financial obligation to the Company and paid Transfer Fee and other related fees according to Company’s Regulations from time to time; (ii) the Transferor has to meet all conditions of transference, corresponds to Membership card’s category in Appendix 1 of the Regulations; (iii) the Transferor has sent the application for the transfer of membership to be approved by the Company.
8.2 The Transfer of Membership is effective when Company issued Membership card to the Transferee. The Company shall give 01 (one) copy of the Club’s Charter and related Regulations to the Transferee after both sides have completed the transfer procedure as regulated.
8.3 The Company shall issue a membership card and The Transferee must attend an interview with the Manager and to ensure they understand all the club policies and rules and regulations. Transferee will acknowledge with a signature and be obligated to follow the club policies, rules and regulations at all times.
8.4 The Transferor shall be held responsible for paying taxes and other fees (if any) and abiding by the “Regulations of Membership Transfer” of the Company at the time of transfer.
8.5 The Transferee shall inherit all privileges of a Club member, and will be held responsible for carrying out all obligations of a Club member immediately after receiving the new membership card.
9.1 Corporate Members may change the nominee(s) of a Corporate Membership, according to the “Regulations for Changing a Membership Card Nominee” when they submit a request and receive approval from the Company Leader.
9.2 The change of (a) nominee(s) of a Corporate membership goes into effect only after the corporation in possession of the card receives approval from the Company Leader and has completed all procedures and paid all related fees according to the Regulations of the Company at that time.
9.3 The nominee(s) must attend an interview with the Manager and to ensure they understand all the club policies and rules and regulations. The nominee(s) will acknowledge with a signature and be obligated to follow the club policies, rules and regulations at all times.
10.1 In event of the death of an Individual member, the Company shall facilitate the transfer of the membership to his/her legal heir.
The legal heir shall submit a request to the Company for the transfer of membership together with the membership card and other related documents of the deceased and proof of inheritance entitlements.
If the transfer is approved, the heir is required to pay the Membership Transfer Fee equal to 50% (fifty percent) of the prevailing Transfer Fee regulated by the Company at the transfer time.
10.2 If there is more than 01 (one) heir, the heirs must reach a unanimous decision as to which individual will inherit the rights to the membership. The Company is not obligated to participate in their discussion.
10.3 In the case of Article 10.1, the procedure for transfer of membership must take place within 12 (twelve) months from the member’s death. If over this period, the membership will be terminated as a result.
11.1 Membership may be terminated by the Company earlier than the expiration date displayed on the membership card if the Club ceases operations for one of the following reasons:
11.1.1 Force majeure such as war, an Act of God such as a flood, tornado, earthquake, or other natural or manmade disturbances or disasters outside of the control of the Company.
11.1.2 The Club ceases operations as a result of the implementation of new planning, zoning by government authorities.
11.2 If the Company ceases operations in the case of Article 11.1.1, the Company is not responsible to compensate Club members.
11.3 If the Company ceases operations in the case of Article 11.1.2, the Company is responsible for compensating Club members with the remaining value of the membership card according to the prevailing price of a membership card of the same type at the time the membership is terminated.
12.1 The Company has the right to supplement, replace, or modify this Charter in order to accord with each development period of the Club. The contents of supplement or replacement are valid only when company leaders sign and seal. Golfers, managers and other persons are responsible for applying updates and implementing strictly all terms and conditions of this Charter, amendments and supplements (if any). In case of difference between this Charter, amendment, additional Charter (herein called “the Charter”) or Regulations of golf operation or agreements, the latest version of the additional charter or signed contract shall prevail.
12.2 This Charter goes into effect from the signing date, and replaces all previous Charters, Regulations, Correspondence, and other documents that contain terms and/or conditions that contradict this Charter.
